What About HIPAA1
and Privacy?
Good news! Use of Chiropractic
HealthWays® Newsletter DOES NOT violate HIPAA regulations in the
area of Marketing, even if the doctor’s name and practice
information are mentioned.
Material published by the Office
of Civil Rights (OCR) of the U.S. Department of Health and Human
Services states, "population-based activities in the areas of
health education or disease prevention" are not considered
marketing when they promote health in a general manner.
Consequently, the forwarding of Chiropractic HealthWays® to
your patient population is acceptable.
Further, OCR states that
Marketing prohibitions do not apply in circumstances where "a
covered entity describe[s] its products or services that are
provided by the covered entity to its patients..." Therefore,
a chiropractor can send a newsletter generally addressing health
issues and chiropractic treatment.
